Terms and conditions

The following Terms and Conditions apply to this website which is operated by bluetinweb. These terms and conditions detail the process for developing and/or managing a website for a client.

Ensure that you read and understand these terms and conditions.


The Contract:
Signing, or acknowledgement via email, of this document is a contractual agreement between the client and bluetinweb. bluetinweb is retained by you our customer as a contractor to meet your specifications. It is important to note that the approval to commence work and the payment of the deposit of 25% indicates that the client accepts the terms and conditions outlined herein.

bluetinweb reserves the right to advertise our involvement in the creation/maintenance of your website through the use of a link in the footer of your website for 12 months or the duration of our support, whichever is longer.


Intellectual Copyright Development:
bluetinweb will hold the intellectual copyright of all material developed by bluetinweb, including source code and original images created by bluetinweb for the client until payment of the final invoice. At this time full ownership will then transfer to the client.


Intellectual Copyright Content:
Accuracy of all content is the responsibility of the client. All artwork and content is to be provided by the client, unless otherwise arranged and the client is responsible for licensing/copyright. All content provided by the client shall remain thier Intellectual Property and bluetinweb will make no claim on it, nor will bluetinweb seek remuneration by way of profit share (royalties) for our role.


Domain Registration and Hosting:
bluetinweb does not register domains names nor provides any hosting facilities. However, bluetinweb recommends clients register their own domain names through our suggested domain registrars and hosting providers.

All costs such as registration of domain name(s) and hosting charges can be included into a quote and bluetinweb can set it up on the client’s behalf, ensuring that the domain name(s) are registered in the client's name and not bluetinweb.

Note: bluetinweb is not affilliated with any domain name registrar nor website hosting provider. The client is free to choose their preferred domain name registrar and/or website hosting provider.

Note: The website hosting service must meet the minimum specifications required by bluetinweb in order to undertake the creation of your site.


Quotations:
The price quoted to the client is for the work listed on the quotation only. Should the client decide that changes are required after work on the website commences, then bluetinweb can accept these changes with the provision that additional charges may need to be renegotiated.


Payment Terms:
Payment for work is currently accepted by the following preferred methods:
~ direct bank transfer
~ Business/Bank cheque
~ cash
~ PayPal invoice

Payment breakdown
25% (Advanced Payment) of the total cost of the project upon acceptance of the quote.
50% of the total cost of the project upon delivery of the first draft.
Final 25% of the total cost of the project upon delivery of the completed website.

Payment of any balance will be due within 7 days of the invoice date. If the payment goes unpaid and there is no response to the notice of payment reminder, the site will be removed until final payment is made. There will be a 20% charge for each 14 day period the balance remains unpaid.

Note: If a cheque is returned by the bank as unpaid for any reason, the client will be liable for a "returned cheque" charge of $40.
The Advanced Payment is non-refundable after work has commenced.


Final Delivery:
If the development timeframe reaches 6 months from the date of commencement due to client delays, it is deemed that the website is complete. Any pages/areas still in work will be turned off for the final release of the website and the final invoice will be issued. Further updates to the site will be carried out as part of our maintenance contract or as an hourly rate, unless negotiated otherwise.


Ongoing Support:
Once the final payment has been received it is deemed that the website is complete. After sales support is available free of charge; however this does not include updates or changes to the website.

bluetinweb offers a maintenance and support contract for a nominal monthly fee (3mth min purchase). The maintenance and support contract includes:
~ checking that your website is still up and running
~ maintaining a monthly backup of your website
~ 3 minor changes to your website content per month (not cumulative)
~ monitoring your website limits

Note: The minor changes do not include fixing issues generated due to client changes to the website.


Rights:
By agreeing to these terms and conditions your statutory rights are not affected.
bluetinweb reserves the right to change or modify any of these terms or conditions at any time.
